Privacy policy

This site is run by By The Owl, a video production house based in Delhi NCR, India, working in India and the UK. By The Owl is a MaybeCreations entity.
The short version: this site doesn't collect personal data on its own. There are no accounts, no sign-ups, no analytics, no advertising pixels and no cookies of ours. The only time we learn anything about you is when you choose to write, call or message us. The rest of this page says exactly what happens then, and what the few third parties on the site do.
What the site does not do
- It doesn't ask you to create an account or log in.
- It doesn't set cookies of its own.
- It doesn't run analytics, tracking or advertising scripts.
- It doesn't store anything you type into the contact form. The form never sends to us (see below).
- It doesn't load fonts, pictures or films from third-party servers. Everything you see and hear on the pages is served from bytheowl.com.
What the site stores in your browser
Two small preferences, neither of which identifies you, leaves your device, or reaches us:
- Whether you've paused the film loops on a page ("bto-films"). Kept in session storage, so it's gone when you close the tab.
- Whether you've turned the moving owl picture on the Services page on or off ("bto-owl-motion"). Kept in local storage until you clear your browser data.
Both also follow your device's "reduce motion" setting. You can clear either at any time from your browser settings.
Hosting
The pages are served by Vercel. Like any web host, Vercel's servers see the technical details of each request (your IP address, browser type, the page asked for, the time) in order to deliver the page and keep the service secure. We don't use that information to identify you. Vercel's own privacy policy covers its handling of that data.
When you contact us
The contact form is a message builder. You fill it in, press a button, and your own email app or WhatsApp opens with the message already written. Nothing you type is stored or sent by this site. The message only reaches us when you press send in your own app.
When you do write, call or message us, we receive what you choose to share: usually your name, your email address or phone number, and what you want made. We use it to reply, to plan and quote the project, and to run it if it goes ahead. We don't sell it, rent it, or add you to a mailing list.
- Email goes to ash@bytheowl.com and sits in our mailbox.
- WhatsApp messages go to +91 9971483528. WhatsApp is run by Meta and has its own privacy policy, which applies to anything sent through it.
- If you call +91 9971483528, we see your number the way any phone does.
We keep enquiries for as long as we need them to reply and to run the project. We keep enquiry emails and WhatsApp chats for up to 2 years after a project ends or doesn't go ahead. Finished projects are governed by their own written agreement.
Third parties on the site
- YouTube. Our films play as short loops served from bytheowl.com. The full version opens in a YouTube player, using youtube-nocookie.com, only when you press play on it. Until you press, nothing is loaded from YouTube. Once you do, Google may set its own cookies and collect data under Google's privacy policy.
- Instagram. The Instagram panel on the Contact page is built from screenshots and reels hosted on our own site. The buttons in it open instagram.com or ig.me in a new tab. What happens there is covered by Meta's privacy policy.
- WhatsApp. The WhatsApp buttons open wa.me, which hands your message to the WhatsApp app. Covered by Meta's privacy policy.
We don't control any of those services and don't receive data from them about your visit here.
Your rights
If you're in India, the Digital Personal Data Protection Act 2023 gives you the right to know what personal data we hold about you, to have it corrected or erased, to have a grievance heard, and to nominate someone to exercise these rights for you.
If you're in the UK, the UK GDPR gives you the right to access the personal data we hold, to have it corrected or erased, to restrict or object to how we use it, to receive it in a portable form, and to complain to the Information Commissioner's Office (ico.org.uk). Our lawful basis for handling an enquiry is our legitimate interest in replying to you, and, once a project is being set up, the steps needed to enter a contract with you.
If you write to us from the UK, your message is read and handled by us in India. Our mailboxes are hosted by our email provider, which may store messages on servers outside India. India isn't covered by a UK adequacy decision, so we rely on the fact that you sent the enquiry to us and on keeping it to the purposes above.
To use any of these rights, email our founder, Ash, at ash@bytheowl.com. We'll reply within 30 days. He also answers privacy questions and grievances.
Children
The site is for businesses and people commissioning video work. It isn't aimed at children and we don't knowingly collect data from anyone under 18.
Changes
If the site starts doing something new with your data (analytics, a form that actually sends, a newsletter), this page changes first, and the date at the top moves. The current version is always the one at bytheowl.com.
